Terms of payment
The order is considered placed when an advance payment of at least 50% of the order value is done. The advance payment is needed before proceeding to the manufacturing of the ordered goods. The payment of the rest of the order value is needed before shipping of the manufactured goods. The payment of the rest of the order value should be done in 3 work days, if not formally agreed otherwise. If the payment is not made at the agreed time after the goods are ready for shipment, the Seller has the right to charge interest of 0.2%/day on the overdue payment amount. The produced goods remain the Seller’s property until full payment has been made by the Buyer.
Terms of delivery and packing
All deliveries are made in DAP (Delivered At Place) mode. Risk transfers from seller to Buyer when the goods are available for unloading; so unloading is at the Buyer’s risk. The Buyer is responsible for import clearance and any applicable local taxes or import duties. for more details, see Incoterms 2010, DAP.
Delivery costs and times
Normally products will be shipped within 5 work days from full order amount payment receipt day. Delivery times may vary depending on the delivery place. No part-deliveries are made. In case of special delivery conditions (exact unloading day/time required, delivery to offshore or remote territories, islands), the costs for additional packing and/or forseeable additional delivery costs may be added on. These special delivery conditions should be declared by the Buyer and formally agreed before order confirmation and manufacturing. If any special delivery conditions are not declared and agreed upon, then the arising additional delivery costs will be charged from the Buyer before shipping.
If the Buyer cannot accept the goods at the agreed delivery date, or the unloading cannot be done at the Buyer’s delivery place after their arrival, the Buyer must inform the Seller immediately, or as soon as possible. In such case one of several solutions, whichever is more reasonable, may take place. Either additional costs of 150€/day for standing truck will be charged, or the goods will be unloaded in the nearest available cargo terminal. There may be other reasonable solutions proposed, depending on circumstances. In any case, the Carrier and the Seller must not be left without compensation for any additional expenses (transportation, terminal handling charges) that arise from this situation of not accepting the goods. The Seller is not responsible for any potential damage risk on the goods during the transportation and goods’ handling in cargo terminal.
The transport company is responsible for the goods until it has reached the Buyer’s delivery address. Any damage or missing goods, if this has been observed, must be noted on the consignment note before receiving the goods. The Buyer must inform the Seller within 48 hours about the incident. All claims concerning the delivery of the goods must be made within 48 hours after the arrival of the goods. Claims should be sent to firstname.lastname@example.org. Please provide information on the order number and/or invoice number, and all available information on the incident. Any claims will be considered, analyzed and then and approved or dismissed by the Seller in written.
Return of goods
The goods are manufactured on special individual orders. Therefore, no returns are accepted, except in case the return is specifically approved in written by the Seller. Returns approved by the Seller must be returned to the Seller’s specified address, and the freight must be paid by the Buyer. On condition that the goods are returned unused and in perfect condition, the Buyer will be credited 50% value of the goods. An online return form must be filled in and enclosed with the returned goods.
Prices and export
The prices can be seen in the price list and cover delivery and order rates up to the next price adjustment time. The prices presented online include VAT. The extra export package prices, as well as customer fees, insurance, landing fees, documentation or similar costs are not included. In case of force majeure, wrong delivery from subcontractors, change of currency situation etc, that affect the agreed prices and the completion of the delivery, the prices on the delivery day are in force and the Seller informs the Buyer that the Buyer has an opportunity to cancel the purchase, and get a refund.
The goods’ freight costs are included in the order price. They cover loading and the transportation to the consignee. Unloading and any other additional operations at Buyer’s unloading site bears on the Buyer.
Any potential disputes between the Buyer and Seller concerning the delivery, do not free the Buyer from his obligation to pay for the order, according to the sales order. Potential disputes should be handled by arbitrators or a court under Lithuanian law.
We reserve the right to change constructions, dimensions and designations concerning the Seller’s products without previous notice.
General warranty terms
The Seller guarantees that goods delivered to the first Buyer have 2 years warranty against material and manufacturing faults counted from the delivery date. In case of commercial use, the warranty term is 6 months. Changeable filters or ozone cartridges/UV lamps are considered as consumables, so they are not included in the warranty. The warranty does not cover lamps and other light sources that can break under normal use. Possible color changes caused by UV-radiation are not included in the warranty. Leaks caused by material and/or manufacturing defects are normally covered in this warranty (see warranty void conditions below).
Warranty void conditions
The warranty does not cover damage that is a result of careless use, secondary damage caused by careless use, incorrect installation carried out by the Buyer or someone the Buyer hired, product modifications, and weather or electric phenomena beyond our control. We can not be responsible for damages and losses resulting from incorrect assembly done by the Buyer or any third party after the delivery. Whenever possible, it is the Buyer’s responsibility to take the necessary precautions to prevent damage either from occurring or worsening. The warranty does not cover any eventual defects that are typical for wooden products. This includes moisture expansion, color changes, cracks and so, which the Buyer could control by carrying out the correct maintenance. Freezing damage that occurred after the delivery is not covered by the warranty. It is up to the Buyer to prevent freezing damage from occurring after the delivery. The warranty does not include problems caused by misuse of chemicals. The Buyer should follow the given recommendations, and in unclear cases he should ask the Seller for advice. The warranty is void if the maintenance tools and materials are used incorrectly.
